Hayesville Man Arrested for Statutory Rape

On 03/03/26 the Towns County Sheriff’s Office notified Clay County Investigator Steven Smith of a statutory sexual assault of a minor. The Towns and Rabun County, Georgia, Sheriff’s Offices began this investigation by receiving detailed information, disclosures, and forensic evidence from a 14-year-old female. It was discovered during their investigation, however, that the assault had actually occurred in Clay County.


The suspect was identified as Terry Dewayne Butler, 42 years of age from Hayesville. All investigative information was provided to Investigator Smith for continued investigation. The victim disclosed that during the summer of 2025 she had been with her father’s girlfriend “hanging out” at Butler’s residence. The victim said that Butler had known her since childhood and was aware of her age. The victim said that while at the residence, Butler had provided her with alcohol throughout the day and she became intoxicated. During her time at the residence, the victim said Butler had intercourse with her.


On 03/06/26, Clay County Lt. Brandon Coker and Investigator Smith interviewed Butler about the allegations. Butler denied any criminal involvement. On 03/26/26, Lt. Coker and Investigator Smith interviewed the girlfriend of the victim’s father who was reportedly present at Butler’s residence on this day. During this interview the woman corroborated the victim’s account of being provided alcohol by Butler as well as him having sexual intercourse with her.


On 04/04/26, Butler was arrested for felony Statutory Rape of a Child Under 15 Years of Age and held without bond.  


All suspects are innocent until proven guilty in a court of law>
